Terms of Use
The rules for using weirmoon.com: what you can do, what we promise and do not promise, accounts, the store, content ownership, and how disputes are handled.
These terms are the agreement between you and Weirmoon LLC ("Weirmoon", "we", "us") about using weirmoon.com (the "site"). By using the site you agree to them. If you do not agree, please do not use the site. The Privacy Policy and Cookie and Local Storage notice explain how information is handled and are part of how the site works, but they are notices, not contract terms.
The short version
- Read, share links, and enjoy the site. Do not break it, scrape it at a scale that hurts it, or use it to harm anyone.
- Our writing, art, and code belong to us or our licensors. Quote and link freely; do not republish wholesale.
- Benchmarks and advice are for information. Hardware is expensive — check before you buy.
- The game is in development. Nothing here is a promise about what ships or when.
- The site is provided as it is. We work hard to keep it up and accurate, but we cannot guarantee it.
Who may use the site
You may use the site if you are at least 13 years old (or the higher age of digital consent where you live) and you are not barred from doing so by law. If you are under the age of majority where you live, ask a parent or guardian before creating an account.
Accounts
You do not need an account to read the site. If you create one:
- give accurate information and keep it current;
- keep your password confidential and tell us if you think someone else has used your account — you are responsible for what happens under it;
- you may close your account at any time through a data request; we may suspend or close an account that is used to break these terms or the law.
Keeping your account secure
Use a long password that you do not use anywhere else; the site asks for at least 15 characters and accepts passphrases and password managers. If you forget it, use Forgot password? on the sign-in page — we will email a single-use reset link to the address on the account. We will never ask for your password by email or message.
What you may and may not do
You agree not to:
- break or bypass the site's security, or probe it for weaknesses without permission (if you find a vulnerability, please report it using our security contact — good-faith reports are welcome);
- overload the site, or use automated tools (crawlers, scrapers) in a way that degrades it for others — ordinary search-engine indexing and feed readers are fine;
- use the site to send spam, malware, or unlawful, harassing, or infringing material;
- pretend to be another person or organisation, or misrepresent your affiliation with Weirmoon;
- use the site in a way that breaks the law.
Our content and your use of it
The site's original text, articles, stories and chapters, benchmark data and charts, artwork, logos, audio, video, and code are owned by Weirmoon LLC or used under licence, and are protected by copyright and other laws. Third-party trademarks belong to their owners (see Copyright, Trademarks and Takedowns).
You may:
- read, link to, and share the site;
- quote short excerpts with attribution and a link back;
- use the press and media materials in the press kit to write about Weirmoon and Valley of Spirits, on the terms stated there;
- quote benchmark figures with attribution and a link back, together with the conditions listed on each result (driver, runtime, and sample count), so the number is not separated from what produced it.
You may not republish whole articles, reuse artwork or the Weirmoon and Valley of Spirits names and marks commercially, or strip credits, without written permission. Open-source components and fonts used by the site remain under their own licences, listed in Copyright, Trademarks and Takedowns.
What you send us
If you send us a message or request, you keep ownership of it. You give us permission to read it, store it, and use it to answer you and to run the site. If you send feedback or an idea, we may use it without owing you anything for it. We will not publish your message or name without asking you first.
The store
The store pages show merchandise and game-related goods. Checkout is not open and no order can be placed on this site at this time. Nothing in the store is an offer for sale until checkout opens. Before any order is accepted we will publish, on this site, the terms of sale — including prices, taxes, shipping, the payment processor, and returns — and update the Privacy Policy accordingly.
Benchmarks, guides, and opinions
Benchmarks, reviews, and buying guides reflect our tests on our hardware at the time they were run, with the conditions stated. Your results will differ with your hardware, software, and settings. They are provided for general information and are not professional, financial, or purchasing advice; you are responsible for decisions you make using them. Product names are used to identify products we have tested and do not imply endorsement by, or affiliation with, their owners.
The game
Weirmoon: Valley of Spirits is in development. Descriptions, images, roadmaps, and status pages describe work in progress and may change or be dropped. Nothing on this site is a promise that a particular feature, platform, price, or release date will exist.
Links and third-party services
The site links to other sites and can embed videos from YouTube and Twitch, and offers sign-in through Google and Microsoft. Those are not ours. Their content, availability, and policies are theirs, and your use of them is under their terms.
Availability and changes
We may change, pause, or remove any part of the site at any time, and we may update these terms. When we do, we change the date at the top of this page; if a change matters to you — for example a change to accounts or the store — we will say so on this page, and by email where we hold your address. Continuing to use the site after a change means you accept it.
No warranties
The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the site will be uninterrupted, error-free, or free from harmful code, or that information on it is complete or current. Some places do not allow some of these exclusions, so some of them may not apply to you.
Limit of liability
To the fullest extent the law allows, Weirmoon LLC, and the people who work for it, will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of, or inability to use, the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars (US$100), or, if you have paid us for something, the amount you paid in the twelve months before the claim, if that is greater. Nothing in these terms limits liability that cannot be limited by law — for example for fraud, or for death or personal injury caused by negligence — or your rights as a consumer under the law where you live.
Indemnity
If your misuse of the site, or your breach of these terms, leads to a claim against us by a third party, you agree to reimburse us for the reasonable costs of dealing with it, to the extent the law allows.
Governing law and disputes
These terms are governed by the laws of the United States and of the state in which Weirmoon LLC is organised, without regard to conflict-of-law rules. Before starting a formal claim, please contact us through the contact form so we can try to sort it out informally; most issues can be. Any claim that cannot be resolved this way will be brought in the courts of that state, and you and we consent to their jurisdiction, except that nothing here removes mandatory consumer rights or protections that apply where you live.
Ending things
You may stop using the site at any time. We may suspend or end access for anyone who breaks these terms or the law. Sections that by their nature should survive — ownership, disclaimers, limits of liability, and disputes — survive.
Accessibility
We want the site to be usable by everyone. Our Accessibility Statement describes the standard we work to, the known gaps, and how to tell us about a barrier — we will help you get what you need another way while we fix it.
General
These terms, together with any terms we publish for a specific feature (such as the store, once it opens), are the whole agreement between you and us about the site. If part of them is found unenforceable, the rest still applies. If we do not enforce a part straight away, we have not given it up. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganisation of the business.
